Job Posting: HR Employment Counsel & Compliance Operations (US/India)
Location: Vadodara, India (Onsite)
Employment Type: Full-Time
Work Hours: 6:30PM–3:00AM IST (Aligned to 8:00AM–5:00PM US Eastern Time Zone)
We are seeking a highly experienced Employment Counsel & Compliance Operations Lead to support our global staffing and SaaS operations. This role blends deep legal expertise (approx. 60%) with operational compliance leadership (approx. 40%) across the US and India. You will serve as a strategic partner to Legal, HR, Compliance, Sales, and Delivery teams, ensuring our employment practices, commercial contracts, and operational controls are robust, scalable, and aligned with regulatory requirements.
What You’ll Do
Legal (Employment & Commercial) – ~60%
- Draft, redline, and negotiate a wide range of commercial and employment-related documents, including MSAs, SOWs, subcontractor/vendor agreements, contractor agreements, NDAs, IP/confidentiality documentation, and privacy notices.
- Advise on worker classification, co-employment, wage and hour matters, leave/accommodation issues, and cross-border data protection including DPAs and SCCs.
- Support client-driven requirements such as HIPAA, BAA reviews, SOC 2, security questionnaires, and privacy compliance.
- Partner with outside counsel on escalations in both the US and India.
- Serve as a strategic adviser to Sales, Operations, HR, and Compliance on legal risk and commercial positioning.
Compliance Operations – ~40%
- Build, enhance, and audit offer-to-start compliance controls for US (W-2, C2C, SOW talent engagement models) and India (FTE and contractor).
- Lead POSH/ICC compliance, including investigations, documentation, training, and statutory adherence.
- Develop compliance dashboards, risk metrics, trend reports, and executive summaries.
- Partner with People & Culture, Delivery, and Finance to maintain accurate policies, procedures, and operational controls.
- Manage escalations and corrective actions across employment, compliance, and contract-related areas.
SaaS (TalentArbor / RangamWorks) Support
- Review and negotiate software licensing, SaaS subscription agreements, technology SOWs, and security/data protection exhibits.
- Partner with Sales and Marketing on RFP/RFI response language, commercial terms, and risk management for product-led deals.
- Ensure SaaS operations comply with relevant contractual, privacy, and regulatory requirements across jurisdictions.
What We’re Looking For
- 8–12+ years of employment law experience, ideally within staffing, MSP/VMS, or high-volume contingent workforce environments.
- Strong background in B2B SaaS contracting, including licensing, subscription models, and technical SOWs.
- JD or LL.B required; active bar membership preferred.
- Expertise in US employment laws (Title VII, ADA, FMLA, FLSA, NLRA) and key India labour laws (Shops & Establishments Act, ID Act, POSH, EPF/ESI, Maternity Benefit Act).
- Strong understanding of worker classification, independent contractor risk, co-employment issues, and compliance frameworks.
- Experience with Fieldglass, Beeline, Coupa, or similar VMS platforms preferred.
- Exceptional drafting, negotiation, judgement, and stakeholder management skills.
- Ability to operate in a high-volume, fast-paced global environment with discretion and precision.
